On Thursday, March 3, 2016, the EDC entered into a settlement agreement with the Clerk, settling a three-year long effort to obtain copies of records in the EDC’s possession related to BlueWare.
As part of the settlement agreement, the EDC admitted its records regarding BlueWare were subject to the Public Records Act due to the EDC’s contract with Brevard County for the purveyance of economic development services in 2012. As a result, the EDC has 45 days from the date of the agreement in which to provide the Clerk all outstanding documents regarding BlueWare which it previously withheld during litigation. Any of documents to be disclosed that the EDC feels may be exempt from under the Public Records Act will be provided to the circuit court for review to determine exemption applicability.
Following the EDC’s complete compliance with the settlement agreement, the Clerk will voluntarily dismiss its lawsuit.
