NOTICE REGARDING RECORDING OF DOCUMENTS
Effective Monday, June 2, 2014, the Brevard County Clerk of the Circuit Court will begin to charge recording fees for the specified documents below. In the past, these documents were recorded without fee. After review of applicable Rules of Court and statute (including but not limited to Rules 1.250(b) and 1.420(f), Fla.R.Civ.P. and Sections 28.222, 28.223, 28.2401, and 28.29, F.S.) the Clerk has determined that these documents will not be recorded without the statutorily prescribed fee(s): Civil Division Documents
• Release or Discharge of Lis Pendens, Dismissal, Stipulation of Dismissal, Notice of Dismissal or Dropping Parties/Count/Case (when Lis Pendens previously recorded)
• Suggestion of Bankruptcy
• Order Discharging Debtor from Bankruptcy Court
• Attorney Charging Liens
• Satisfaction of Judgment
Probate/Guardianship Division Documents
• Probate/Guardianship Bonds
• Probate Commissions
• Appointment and Acceptance of Resident Agent
• Florida Final Certificate of Inheritance and Estate Tax
• Federal Estate Tax Closing Letter
• Order Determining Beneficiaries
• Orders Appointing/Removing Trustee
• All Probate Petitions
• Orders Approving Annual Returns of Guardian
• Personal Representative’s Release and Distribution of Real Property
• Assignment of Inheritance/Interest
• Disclaimer of Inheritance/Interest
• Certified Copies of Death Certificates
The current cost to record each of these documents is $10 for the first page and $8.50 for each subsequent page. The cost for indexing is $1 per name over four (4) names. Payment for the appropriate service fees for these documents may be accomplished through the ePortal at the time of filing.
