The Board of County Commissioners of Brevard County, Florida, met in regular session on October 23, 1997, at 5:01 p.m. in the Government Center Commission Room, Building C, 2725 Judge Fran Jamieson Way, Melbourne, Florida. Present were: Vice Chairman Helen Voltz, Commissioners Truman Scarborough, Nancy Higgs and Mark Cook, Community Development Administrator Peggy Busacca, and Assistant County Attorney Eden Bentley. Absent were: Commissioner Randy O'Brien, County Manager Tom Jenkins, and County Attorney Scott Knox.
Vice Chairman Voltz led the assembly in the Pledge of Allegiance.
DISCUSSION, RE: SCOTTSMOOR LANDING BOAT LAUNCH
Motion by Commissioner Scarborough, seconded by Commissioner Cook, to authorize the Vice Chairman to send a letter to the State inquiring what studies were done concerning the grasses at Scottsmoor Landing Boat Launch. Motion carried and ordered unanimously.
RESOLUTION, RE: CREATING COMMUNITY ACTION AGENCY ADVISORY COMMITTEE
Motion by Commissioner Scarborough, seconded by Commissioner Cook, to direct staff to schedule resolution creating the Community Action Agency Advisory Committee, with comments from the Community Based Organization, Community Development Block Grant Boards, and Community Action Agency Board, on the agenda for consideration by the Board. Motion carried and ordered unanimously.
DISCUSSION, RE: THE BOEING COMPANY
Commissioner Cook stated there was a debriefing on Monday from the Boeing Company representatives; and inquired if anyone from the County was in attendance and will comments be coming back.
Community Development Administrator Peggy Busacca stated the Economic Development Commission (EDC) will provide a debriefing to Team Brevard, and it will put those comments together; when the Boeing Company representatives came forward, they thanked the EDC for making it a very small group; and she simply responded to an invitation and received a fax that was sent to the Team Brevard members which said there would be a briefing by the EDC about this in the future and it would notify Brevard County as to the date.
Commissioner Cook noted he would have liked to have seen the Chairman of the Board invited to this as it was an important issue; but he is glad someone from the County attended the debriefing.
PUBLIC HEARING, RE: ORDINANCE AMENDING ZONING REGULATIONS PERTAINING TO PETS AND ANIMALS
Vice Chairman Voltz called for the public hearing to consider an ordinance amending the Zoning Regulations pertaining to pets and animals. She advised the Board has been requested by staff to allow another 90 days for this issue in order to get all the information.
Chief Senior Planner Tom Meyers stated there will be three ordinances coming back to the Board; one ordinance will deal with pets; it would be the definition of what animals individuals would be allowed to have in any residential zoning classification or apartment; and there will be another ordinance dealing with what CUPs for additional animals can be applied for on lots at least one acre. He noted what was withdrawn from tonight's changes to the AU zoning classification was a provision that would have limited the raising and grazing of animals to 2 ? or greater acre lots; and those are all not being considered tonight; however, they will be considered in 90 days when staff prepares ordinances that will deal with animals as pets, animals on one-acre lots, and animals in the agricultural zoning classification.
Commissioner Scarborough stated he has never had a complaint in an agricultural area that there is a non-conforming lot less than 2 ? acres and there is someone grazing a sheep, cow, horse, etc.; and he is willing to support a motion to eliminate this and let the people in attendance go home. Commissioner Cook advised he has not received any complaints either; the current Ordinance is working; and inquired why should the Board create a problem by bringing everything back up. Commissioner Scarborough stated he is only referring to the agricultural animal issue and not the commercial issue.
There being no further comments or objections heard, motion was made by Commissioner Scarborough, seconded by Commissioner Cook, to direct staff to not bring back to the Board anything relating to grazing of animals or raising of fowl for non-conforming AU lots under 2 ? acres. Motion carried and ordered unanimously.
Robert Waters stated he has one-acre of property zoned AU; and the way the proposal is looking, he is not going to be able to have any type of farm animals on it.
Commissioner Higgs stated the Board voted not to amend the section that deals with the grazing and raising of animals. Vice Chairman Voltz stated Mr. Waters can continue to do what he has been doing.
Fred Morton expressed appreciation to the Board for the aforementioned motion; stated he owns a feed store; and it would have put him out of business.
Marilyn Bissell stated she has medical problems and lives on a one-acre lot in Mims; her husband and she purchased the property with the understanding they could have animals; everyone around her has animals; and she needs the enzymes from the raw goat milk or she cannot get out of bed.
Motion by Commissioner Scarborough, seconded by Commissioner Higgs, to authorize staff to work on Conditional Use Permits (CUPs) and provide options that allow the County to be careful and selective, if necessary, in Rural Residential (RR-1) and Rural Residential Mobile Home (RRMH-1) zonings, including compatibility with surrounding areas. Motion carried and ordered unanimously.
Motion by Commissioner Scarborough, seconded by Commissioner Cook, to direct staff to hold in abeyance any Code Enforcement violation against Marilyn Bissell regarding her goats. Motion carried and ordered unanimously.
Dr. Charles Gillespie stated he owns emus, and provided pictures for the Board's review. Commissioner Cook stated the Board addressed Dr. Gillespie's problem also.
Robert Swann, President of North Brevard Horseman's Club, stated there are 70 families represented; and a lot of them are affected by the proposed pet ordinance. Commissioner Cook stated the motion takes care of Mr. Swann's concerns.
Marlene Waters expressed appreciation to the Board for its prior motion concerning AU zoning.
Dwight Greenberg stated he is a bird breeder; and there are a lot of resources and people who deal with different types of animals that could be contacted, if necessary.
Mark Buddenhagen stated he is present on behalf of Marilyn Bissell; and expressed appreciation to the Board for reviewing her circumstance.
Susan Canada stated she would like to see a provision providing for fostering wildlife when in conjunction with a wildlife rehabilitator or a veterinarian.
Motion by Commissioner Scarborough, seconded by Commissioner Cook, to direct staff to look at broadening the definition of shelter exemption to shelter operation to include employees or individuals authorized by the shelter to temporarily take care of animals on sites other than the shelter. Motion carried and ordered unanimously.
Mary Dean stated she is a 4-H leader; most of the issues that concerned her have been taken care of when AU zoning is left as it is; and urged the Board to consider how many rabbits or guinea pigs should be allowed as compared to horses.
Motion by Commissioner Cook, seconded by Commissioner Scarborough, to exempt pet rabbits from the number requirement. Motion carried and ordered unanimously.
PERSONAL APPEARANCE - MAYOR LARRY BARTLEY, CITY OF TITUSVILLE, RE: PROJECT ANCHOR AND BOEING COMPANY SITE SELECTION
Mayor Larry Bartley, City of Titusville, stated he is also President of the Space Coast League of Cities; and expressed appreciation to the Board for its work toward the Boeing site selection. He stated there were a lot of players involved in this; a lot of hours, time and energy went into this; and he wishes things had turned out differently. He noted he hopes Brevard County and the municipalities can continue to work together so they will win the next time around.
PERSONAL APPEARANCES - DR. AND MRS. LOUIS MENSA OF GHANA, RE: PRESENTATION TO THE BOARD
Mayor Larry Bartley, City of Titusville, introduced Dr. and Mrs. Louis Mensa of Ghana to the Board and audience.
Dr. Louis Mensa stated his wife Rose and he are present to show their appreciation for their stay in Titusville and Brevard County; and provided samples of things that the children of Ghana have made as a token of their appreciation. He stated he and his wife are happy for the generosity and hospitality they have received while being here.
Upon motion and vote, the meeting adjourned at 6:25 p.m.
