MINUTES OF THE MEETING OF THE BOARD OF COUNTY COMMISSIONERS
The Board of County Commissioners of Brevard County, Florida, met in regular session on August 1, 1996, at 9:10 a.m. in the Government Center Commission Room, Building C, 2725 Judge Fran Jamieson Way, Melbourne, Florida. Present were: Chairman Mark Cook, Commissioners Truman Scarborough, Randy O?Brien, Nancy Higgs, and Scott Ellis, County Manager Tom Jenkins, and County Attorney Scott Knox.
The Invocation was given by Commissioner Nancy Higgs, District 3.
Commissioner Scott Ellis led the assembly in the Pledge of Allegiance.
ITEMS PULLED FROM CONSENT AGENDA
Commissioner Higgs pulled Item III.A.2. and Commissioner O?Brien pulled Item III.B.3 from the Consent Agenda.
APPOINTMENT, RE: LIVE-ABOARD VESSEL COMMITTEE
Motion by Commissioner O?Brien, seconded by Commissioner Ellis, to appoint Dr. Caroliese Schmidt, 970 Loggerhead Island Drive, Satellite Beach, Florida 32937, to the Live-Aboard Vessel Committee, with term of appointment expiring August 1, 1997. Motion carried and ordered unanimously.
DISCUSSION, RE: PALM SHORES TOWN MEETING
Chairman Cook advised he has been requested to attend the Palm Shores Town Meeting this month to discuss the jail surtax; and a staff member from the County Manager?s Office can also attend.
DISCUSSION, RE: MEETING WITH VIRGINIA WEATHERALL
Chairman Cook advised he has an appointment with Virginia Wetherell on August 7, 1996 in Tallahassee and will take a staff member with him.
PERSONAL APPEARANCES - BUDGET OFFICE, RE: GFOA DISTINGUISHED BUDGET PRESENTATION AWARD
County Manager Tom Jenkins explained the GFOA Distinguished Budget Presentation Award given to the Budget Office.
The Board acknowledged receipt of and formally presented the Government Finance Officers Association (GFOA) award to the Budget Office staff.
CONDITIONAL WAIVER OF ADMINISTRATIVE FINES AND RELEASE OF LIEN, RE: CODE ENFORCEMENT BOARD LIEN ON JOHN W. HOWARD?S PROPERTY
Motion by Commissioner Higgs, seconded by Commissioner Scarborough, to execute Conditional Waiver of Administrative Fine and Release of Lien on property at 6019 Palm Street, Mims, Florida. Motion carried and ordered unanimously.
PERMISSION TO ADVERTISE REQUEST FOR PROPOSALS, RE: 9-1-1 DIGITAL LOGGING RECORDERS
Motion by Commissioner Higgs, seconded by Commissioner Scarborough, to grant permission to advertise Request for Proposals to qualified digital logging recorder companies for procurement of eleven Digital Logging Recorders for the Public Safety Answering Points in the Countywide Enhanced 911 System; and appoint a Selection Committee consisting of Leslie Lewis, Chief Mark McMichael, Chief Fernez, Dan Stack, Captain Crawford, Lt. Bill Carter, and Leslie Rothering, with the E-911 Communications System Manager chairing the Committee as a non-voting member except in the case of a tie. Motion carried and ordered unanimously.
SETTLEMENT OF PLAINTIFF?S ATTORNEY?S FEES, RE: CAMPBELL V. BREVARD COUNTY
Motion by Commissioner Higgs, seconded by Commissioner Scarborough, to authorize settlement of Plaintiff?s attorney?s fees in the amount of $27,787.50 in the case of Campbell v. Brevard County. Motion carried and ordered unanimously.
ACKNOWLEDGE RECEIPT, RE: AUDIT OF OFFICE OF THE STATE ATTORNEY
Motion by Commissioner Higgs, seconded by Commissioner Scarborough, to acknowledge receipt of the Audit of the Office of the State Attorney for the period from January 1, 1995 through December 31, 1995. Motion carried and ordered unanimously.
DISCUSSION, RE: NAMING CENTRAL BREVARD LIBRARY AND REFERENCE CENTER AFTER MARIE HOLDERMAN
Commissioner O?Brien advised he has received comments from individuals that the public buildings are not being named after veterans; and he cannot support the item today because of that.
Commissioner Higgs stated the County needs to look at how it names all of its buildings and coordinate how it goes about naming its facilities rather than doing it one by one.
Motion by Commissioner Higgs, seconded by Commissioner O?Brien, to refer naming County facilities to staff and the Historical Commission for recommendations on how to have a more systematic way of naming such facilities; and provide recommendations to the Board. Motion carried and ordered unanimously.
RECOMMENDATION, RE: DIRECT COUNTY MANAGER TO SHOW COMPARATIVE NUMBERS ON MONTHLY HIRE LIST
The Board directed the County Manager to show the total number of employees Brevard County had in 1988 through 1995 and how many it has now in his monthly report.
PERSONAL APPEARANCE - BRENT BALDWIN, CENTRAL BREVARD SOCCER CLUB REPRESENTATIVE, RE: SPONSORSHIP FOR AAU JUNIOR OLYMPICS
Brent Baldwin requested the Board approve funding in the amount of $500 to sponsor the AAU Junior Olympics in New Orleans on August 5, 1996.
Discussed ensued regarding sponsorship for the AAU Junior Olympics.
Motion by Commissioner O?Brien, seconded by Commissioner Scarborough, to authorize the Chairman to prepare and sign a commendation resolution for the Central Brevard Soccer Club who will attend the AAU Junior Olympics. Motion carried and ordered unanimously.
APPROVAL, RE: BILLS AND BUDGET TRANSFERS
Commissioner O?Brien expressed concern that Federal Express should not be used unless in emergency cases.
Motion by Commissioner Scarborough, seconded by Commissioner O?Brien, to approve bills and budget transfers as submitted, minus the Federal Express bills from Holland & Knight on Pages 19, 20, 69 and 70. Motion carried and ordered unanimously.
WAIVER OF MAXIMUM CONSTRUCTION DISTANCE, RE: SERNA AVENUE EXTENSION
Commissioner Higgs inquired about the increased maintenance cost to the County, the implications of increasing the unpaved road to the eventual paving of the entire road, and what would be the effect of the additional length of unpaved road on the whole Municipal Service Benefit Unit (MSBU) project.
Code Compliance Director Ralph Brescia advised staff will report back to the Board with the requested information.
Motion by Commissioner Higgs, seconded by Commissioner O?Brien, to table waiver of maximum construction distance of the dirt road Ordinance from 1,320 feet to 1,795 feet for Serna Avenue Extension to the August 20, 1996 meeting; and direct staff to find out what the increased maintenance cost to the County will be, the implications of increasing the unpaved road to the eventual paving of the entire road, and what would be the effect of the additional length of unpaved road on the whole MSBU project. Motion carried and ordered unanimously.

PUBLIC HEARING, RE: ADOPTION OF TENTATIVE MILLAGES FOR FY 1996-97
Chairman Cook called for the public hearing to consider adoption of tentative millages for FY 1996-97.
Robert Ehrhardt requested the Board?s support in continuation of the County?s Adult Literacy Program.
Motion by Commissioner Scarborough, seconded by Commissioner Ellis, to support continuation of the County?s Adult Literacy Program; and direct Library Services Director Kathryn Stewart to come back with alternatives for possible cuts. Motion carried and ordered unanimously.
County Manager Tom Jenkins outlined the procedures for adoption of the tentative millages for FY 1996-97.
The Board discussed previous budget workshops, millages, reserves, debt service, sales tax, beach and riverfront funds, additional budget workshops, no millage increase Countywide, general fund, aggregate, ad valorem taxes, EELS bond, TRIM notice, roll back and roll forward, and various issues relating to Board Departments and the tax districts.

The meeting reconvened at 1:35 p.m.
Discussed ensued on the Justice Center, correctional officers, Public Safety Department, Economic Development Commission, Supervisor of Elections, Law Library, Court Administration, Housing and Human Services, Medicaid, compensation and benefits, court costs, operating expenses, cash carry forward, capital replacement and reserves, and various budget reductions.
General Revenue - Countywide
Budget Director Kathy Wall advised the tentative millage for General Revenue - Countywide is 4.3081 mills.
Motion by Commissioner Scarborough, seconded by Commissioner O?Brien, to approve tentative millage for General Revenue - Countywide at 4.3081 mills. Motion carried and ordered; Commissioners Cook and Ellis voted nay.
Library District
Ms. Wall advised the tentative millage for the Library District is 0.7504 mill.
Motion by Commissioner Scarborough, seconded by Commissioner O?Brien, to approve tentative millage for the Library District at 0.7504 mill. Motion carried and ordered unanimously.
Mosquito Control District
Ms. Wall advised the tentative millage for Mosquito Control District is 0.2240 mill.
Motion by Commissioner Scarborough, seconded by Commissioner Higgs, to approve tentative millage for Mosquito Control District at 0.2240 mill. Motion carried and ordered unanimously.
Fire Control Municipal Service Taxing Unit
Ms. Wall advised the tentative millage for Fire Control Municipal Service Taxing Unit is 1.5810 mills.
Motion by Commissioner Ellis, seconded by Commissioner O?Brien, to approve tentative millage for Fire Control Municipal Service Taxing Unit at 1.5810 mills. Motion carried and ordered; Commissioner Higgs voted nay.
Recreation District 1 Municipal Service Taxing Unit
Ms. Wall advised the tentative millage for Recreation District 1 Municipal Service Taxing Unit is 0.4575 mill.
Motion by Commissioner Scarborough, seconded by Commissioner O?Brien, to approve tentative millage for Recreation District 1 Municipal Service Taxing Unit at 0.4575 mill. Motion carried and ordered unanimously.
Recreation District 4 Operation and Maintenance
Ms. Wall advised the tentative millage for Recreation District 4 Operation and Maintenance is 0.5921 mill.
Motion by Commissioner Scarborough, seconded by Commissioner O?Brien, to approve tentative millage for Recreation District 4 Operation and Maintenance at 0.5921 mill. Motion carried and ordered unanimously.
TICO Airport Authority
Ms. Wall advised the tentative millage for TICO Airport Authority is 0.0257 mill.
Motion by Commissioner O?Brien, seconded by Commissioner Cook, to approve tentative millage for TICO Airport Authority at 0.0257 mill. Motion carried and ordered unanimously.
Law Enforcement Countywide Municipal Service Taxing Unit
Ms. Wall advised the tentative millage for Law Enforcement Countywide Municipal Service Taxing Unit is 0.8913 mill.
Motion by Commissioner O?Brien, seconded by Commissioner Scarborough, to approve tentative millage for Law Enforcement Countywide Municipal Service Taxing Unit at 0.8913 mill. Motion carried and ordered unanimously.
Road and Bridge District 1 Municipal Service Taxing Unit
Ms. Wall advised the tentative millage for Road and Bridge District 1 Municipal Service Taxing Unit is 0.7712 mill.
Motion by Commissioner Scarborough, seconded by Commissioner O?Brien, to approve tentative millage for Road and Bridge District 1 Municipal Service Taxing Unit at 0.7712 mill. Motion carried and ordered unanimously.
Road and Bridge District 2 Municipal Service Taxing Unit
Ms. Wall advised the tentative millage for Road and Bridge District 2 Municipal Service Taxing Unit is 0.4457 mill.

Ms. Wall advised the tentative millage for Road and Bridge District 3 Municipal Service Taxing Unit is 0.6737 mill.

Road and Bridge District 4 Municipal Service Taxing Unit
Ms. Wall advised the tentative millage for Road and Bridge District 4 Municipal Service Taxing Unit is 0.4867 mill.

Road and Bridge District 5 Municipal Service Taxing Unit
Ms. Wall advised the tentative millage for Road and Bridge District 5 Municipal Service Taxing Unit is 0.7533 mill.

Ms. Wall advised the tentative millage for Road and Bridge District 4 Municipal Service Taxing Unit Beaches is 0.5983 mill.

Ms. Wall advised the tentative millage for Road and Bridge District 4 Municipal Service Taxing Unit South Merritt Island is 0.2495 mill.

Environmentally Endangered Lands
Ms. Wall advised the tentative millage for Environmentally Endangered Lands is 0.2500 mill.

Beach and Riverfront Acquisition
Ms. Wall advised the tentative millage for Beach and Riverfront Acquisition is 0.2144 mill.

Port St. John/Canaveral Groves Recreation Municipal Service Taxing Unit
Ms. Wall advised the tentative millage for Port St. John/Canaveral Groves Recreation Municipal Service Taxing Unit is 0.9000 mill.
Motion by Commissioner Scarborough, seconded by Commissioner O?Brien, to approve tentative millage for Port St. John/Canaveral Groves Recreation Municipal Service Taxing Unit at 0.8494 mill. Motion carried and ordered unanimously.
Aggregate Non-voted
Ms. Wall advised the tentative millage for Aggregate Non-voted is 6.7668 mill.
Motion by Commissioner Scarborough, seconded by Commissioner Higgs, to approve tentative millage for Aggregate Non-voted at 6.7668 mill. Motion carried and ordered unanimously.
The Board directed the County Manager to coordinate with the Commissioners? offices to schedule one or two additional budget workshops prior to the final budget hearing.
Upon motion and vote, the meeting adjourned at 3:10 p.m.
