MINUTES OF THE MEETING OF THE BOARD OF COUNTY COMMISSIONERS
BREVARD COUNTY, FLORIDA
August 20, 2009
The Board of County Commissioners of Brevard County, Florida, met in special session on August 20, 2009, at 5:33 p.m. in the City of West Melbourne City Council Chambers, 2285 Minton Road, West Melbourne, Florida. Present were: Vice Chairman Mary Bolin, Commissioners Trudie Infantini, and Andy Anderson, and Assistant County Attorney Morris Richardson. Absent were: Chairman Chuck Nelson, and Commissioner Robin Fisher.
Vice Chairman Mary Bolin led the assembly in the Pledge of Allegiance.
REPORT, RE: CONFLICT OF INTEREST
Commissioner Anderson stated for the record he checked with Tallahassee as far as the Ethics Commission, regarding his brother being a long-term employee of Melbourne-Tillman Water Control District; and he wanted to let the Board know there was no conflict.
PUBLIC HEARING, RE: STATEMENT OF PROPOSED USER FEE RATES FOR
MELBOURNE-TILLMAN WATER CONTROL DISTRICT______________________

Vice Chairman Bolin called for public hearing to consider statement of proposed user fee rates for Melbourne-Tillman Water Control District for FY 2009-2010.
Al Pennell, Manager/Engineer of Melbourne-Tillman Water Control District, stated present today are: John Devivo, President of the Melbourne-Tillman Water Control District Board; Members Joe Hale, Charlotte Lucart, Bob Hagle, and staff member Debbie Le Clair Secretary/Treasurer to the Board. He stated in February 2009, the District Board of Directors adopted the tentative budget for submittal to Brevard County’s Budget Office, for fiscal year 2009-2010; the budget was based on the 20-year capital reinvestment plan and current operational costs; this budget has been adopted without a user fee increase; thus the district is requesting the Board’s approval for the adoption of user fee rates for fiscal year 2009-2010 as follows: Residential $19.13 per acre or portion thereof, the same rate since 2006-2007; Commercial $37.14 per acre or portion thereof, the same rate since 2006-2007; and Agricultural $6.69 per acre or portion thereof, the same rate since 2006-2007.
He stated that Melbourne Tillman would like to recognize Jim Ernest who has been their coordinator in the Budget Office for as long as he has been there; and they understand that this is coming close to his last formal act; and he wanted to express thanks to him for all his help, support, and guidance over the last several years.
Commissioner Bolin also stated thanks to Mr. Ernest for his work.

Vice Chairman Bolin called for the public hearing to consider tentative approval of proposed user fee rates for Melbourne-Tillman Water Control District for FY 2009-2010.
Motion by Commissioner Infantini, seconded by Commissioner Anderson, to grant tentative approval of proposed rates as requested by the Melbourne-Tillman Water Control District for FY 2009-2010 of $19.13 per acre or portion thereof for Residential, the same rate since 2006-2007; $37.14 per acre or portion thereof for Commercial, the same rate since 2006-2007; and $6.69 per acre or portion thereof for Agricultural, the same rate since 2006-2007. Motion carried and ordered unanimously.
Upon motion and vote meeting adjourned at 5:37 pm.
